Administrative Law Judge


The third major step in the Medicare appeals process is often the most important. After an unfavorable or partially favorable reconsideration decision, a provider (usually) has the right to appeal the decision to an administrative law judge (ALJ). The ALJs work through the Office of Medicare Hearings and Appeals (OMHA), which have 4 regions throughout the country. Importantly, this is the first and generally only level where a provider can explain their position to an actual person. ALJ Hearings are held usually by telephone, but may also be held through a video-teleconference or rarely face-to-face.
